1031 Exchange Process

Once an investor sells a property, they have 45 days to identify a like-kind property (or properties) of equal or greater value plus an additional 135 days (if needed) to close on any identified property (or properties). This means that investors must acquire the new property and complete the exchange within 180 days (45+135=180) of closing on the relinquished property in a 1031 exchange.

1031 Requirements

To qualify for a 1031 exchange, taxpayers must work with a QI (like Leader1031) to structure the transaction as an exchange and not a standard sale. A QI must also be involved prior to closing of the sold property to create an exchange agreement with the taxpayer and obtain other documentation. Real estate investors must identify any replacement property in writing in a timely manner and their QI must hold the proceeds and apply them only toward the acquisition of replacement property.

A 1031 Exchange provides the ability to defer capital gains taxes on the sale of investment property (“relinquished property”) thus providing a path to potential wealth building.

The transaction must be structured as an exchange and not just a sale, followed by a purchase, and a Qualified Intermediary (QI) must be involved prior to the closing of the relinquished property to create an exchange agreement with the taxpayer, including the assignment of the purchase contract, the identification of the replacement property, and other supporting documentation. The QI must hold the proceeds during the exchange period and for the acquisition of the replacement property.
